OVERVIEW

This website is operated by EverWonder Post. Throughout the website, the terms “we”, “us” and “our” refer to EverWonder Post.

EverWonder Post provides this website, its content, products, purchase options and related services to you subject to these Terms of Service and the policies referenced herein.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and services.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy, Shipping Policy and Purchase Options Cancellation Policy.

If you do not agree to these terms, you should not use the website or purchase our products.

SECTION 1 — ELIGIBILITY AND CUSTOMER ACCOUNTS

You must be at least the age of legal majority in your country or place of residence to make a purchase.

EverWonder Post products are intended to be purchased and managed by adults, even when the recipient is a child.

You are responsible for ensuring that all account, contact, billing, personalisation and shipping information you provide is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

SECTION 2 — CHILDREN’S INFORMATION AND ADULT RESPONSIBILITY

An adult placing an order may provide limited information about a child or family where necessary to personalise the product, such as a first name, family name and selected language.

By providing this information, the purchaser confirms that they are the child’s parent, legal guardian or another adult authorised to provide the information and arrange the delivery.

Customers must not submit unnecessary sensitive information about a child.

EverWonder Post products are family experiences intended to be opened, read and used with appropriate adult supervision.

Small decorative pieces, stickers, paper components, sealing materials or other small elements may be included. These products are not toys and are not suitable for very young children without direct adult supervision.

SECTION 3 — PRODUCTS AND PERSONALISATION

EverWonder Post creates personalised physical mail experiences containing story chapters, letters, postcards, puzzles, activities, printed materials, keepsakes and decorative details.

Products are prepared according to the personalisation information selected or supplied by the customer, including the recipient’s name or family name and chosen language.

Customers must review all personalisation information carefully before completing an order. EverWonder Post is not responsible for errors caused by incorrect information supplied by the customer.

Because our products are personalised and prepared specifically for each order, we may be unable to change or cancel an order after it has been accepted.

Product photographs and illustrations are presented for reference. Colours, paper, printing, placement, handmade details, packaging and decorative elements may vary slightly from the images displayed on the website. These normal variations do not constitute a defect.

We may improve or make minor changes to materials, activities, illustrations, packaging or decorative details provided that the essential nature and value of the purchased experience are not materially reduced.

SECTION 4 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase.

An order is accepted after payment has been successfully processed and an order confirmation has been issued. We reserve the right to reject or cancel an order for legitimate reasons, including:

• Payment failure or suspected fraud
• Incorrect pricing or material website errors
• Product or delivery unavailability
• Incomplete or invalid customer information
• A delivery destination we cannot reasonably serve
• A violation of these Terms of Service

If we cancel an accepted order without fulfilling it, we will refund the applicable amount unless the cancellation results from fraud, abuse, chargeback misconduct or another lawful reason permitting us to withhold payment.

Products are for personal or household use and may not be reproduced, resold or commercially distributed without our prior written permission.

SECTION 5 — PRICES, PAYMENTS AND CURRENCIES

The price displayed and confirmed at checkout is the price applicable to the order.

Standard shipping is included for eligible destinations unless expressly stated otherwise at checkout.

Prices may be displayed in different currencies depending on the customer’s location. Currency conversion, payment processing and card issuer practices may affect the final amount shown on a customer’s statement.

Any optional service or upgraded delivery method selected by the customer may incur an additional charge.

We may change prices, discounts or promotions at any time. Changes will not affect an order that has already been accepted, except where the displayed price resulted from an obvious material error.

Customers must provide accurate and authorised payment information and confirm that they are entitled to use the selected payment method.

SECTION 6 — MONTHLY MEMBERSHIP

The Monthly Membership is an automatically renewing purchase option.

The customer is charged monthly and receives one personalised delivery for each successfully completed payment.

The membership continues with future EverWonder themes after the Christmas season unless cancelled.

Customers may cancel future renewals at any time before the next renewal date through their customer account or by contacting hello@everwonderpost.com.

Cancellation applies to future renewals only. It does not reverse or refund a payment that has already been processed.

Deliveries already covered by a completed payment will continue to be prepared and fulfilled.

SECTION 7 — CHRISTMAS SEASON PASS

The Christmas Season Pass is a one-time prepaid purchase covering the complete four-delivery Christmas Mystery experience from September through December.

It does not renew automatically.

Because the Season Pass and its contents are personalised for the recipient, the purchase cannot be cancelled, returned or refunded after the order is placed, except where required by applicable law.

Orders placed after a scheduled delivery month may receive previous chapters together with the next available delivery. Season Pass orders placed after 5 September may receive the September and October chapters together.

Receiving two chapters together does not reduce the number of chapters included and does not qualify the order for cancellation or refund.

SECTION 8 — RETURNS, REFUNDS AND CANCELLATIONS

EverWonder Post products are made to the customer’s specifications and are clearly personalised. All purchases are therefore final to the fullest extent permitted by applicable law.

We do not provide returns, exchanges or refunds for change of mind, failure to cancel before renewal, incorrect customer-provided information, personal preference or postal delays outside our reasonable control.

Nothing in these Terms excludes any mandatory consumer right that cannot legally be excluded.

Damaged, defective or materially incorrect products will be handled according to our Return and Refund Policy.

SECTION 9 — SHIPPING AND DELIVERY

Orders are prepared and dispatched according to the applicable monthly production schedule.

All delivery dates and transit times are estimates and are not guaranteed.

Delivery may be affected by postal carriers, customs authorities, weather, public holidays, seasonal volume, strikes, transportation interruptions and other circumstances outside our reasonable control.

Unless expressly stated otherwise at checkout or in the dispatch confirmation, deliveries are sent using standard postal mail and may not include end-to-end tracking.

EverWonder Post is not responsible for failed delivery caused by an incorrect, incomplete or outdated address supplied by the customer, refusal of delivery, failure to collect mail or failure to comply with local postal or customs requirements.

Our responsibilities concerning delays, missing deliveries, address errors and reshipments are explained in our Shipping Policy.

SECTION 10 — INTELLECTUAL PROPERTY

All EverWonder Post content is owned by or licensed to EverWonder Post and is protected by applicable copyright, trademark and other intellectual property laws.

Protected content includes, without limitation:

• Stories, plots, characters and fictional worlds
• Letters, newspapers, postcards and written content
• Puzzles, clues, crosswords and activities
• Illustrations, photographs, graphics and designs
• Logos, product names, slogans and branding
• Videos, audio, website content and social media materials
• Product layouts, printed materials and downloadable content

A purchase grants the customer a limited right to use the physical product privately for personal or family enjoyment.

Customers may not copy, scan, reproduce, translate, modify, publish, distribute, sell, sublicense, upload, commercially exploit or create derivative products from EverWonder Post content without prior written permission.

Purchasing a product does not transfer ownership of any intellectual property rights.

SECTION 11 — ACCEPTABLE USE

You may use the website only for lawful personal purposes.

You must not:

• Use the website or products for unlawful, fraudulent or abusive purposes
• Attempt to gain unauthorised access to the website or another customer’s account
• Introduce malicious code, viruses or disruptive technology
• Scrape, extract or systematically collect website content or customer information
• Reproduce or commercially exploit any portion of the website
• Infringe our rights or the rights of another person
• Submit false, misleading, abusive, defamatory or unlawful content
• Interfere with the security or normal operation of the website

We may restrict or terminate access where we reasonably believe these terms have been violated.

SECTION 12 — THIRD-PARTY SERVICES AND LINKS

Our website may use or link to services provided by third parties, including Shopify, payment providers, subscription applications, personalisation tools and postal services.

Third-party services may be governed by their own terms and privacy practices.

We are not responsible for the content, security or availability of an independent third-party website that is not controlled by EverWonder Post.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, which provides the platform used to operate the website and process certain information.

Purchases from this store are made directly from EverWonder Post, not from Shopify. Shopify is not the seller of EverWonder Post products and is not responsible for their creation, personalisation, fulfilment or delivery.

SECTION 14 — PRIVACY

Personal information is handled according to our Privacy Policy and applicable data-protection law.

Information required to process orders may be shared with service providers such as Shopify, payment processors, subscription and personalisation applications, email providers and postal or delivery services.

Customers should review our Privacy Policy for further information about how personal data is collected, used, stored and shared.

SECTION 15 — FEEDBACK AND REVIEWS

If you voluntarily submit a review, testimonial, suggestion, photograph or other feedback, you confirm that you have the right to provide it and that it does not violate another person’s privacy or intellectual property rights.

You grant EverWonder Post a non-exclusive, worldwide, royalty-free right to use, reproduce and display that feedback for operating, improving and promoting the business, subject to applicable privacy law and any specific permission required for images identifying a child.

We will not publicly use an identifiable image of a child for promotional purposes without the appropriate adult’s permission.

We may remove feedback that is unlawful, fraudulent, abusive, misleading or infringes another person’s rights.

SECTION 16 — ERRORS AND AVAILABILITY

The website may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, prices, promotions, availability or delivery information.

We may correct errors and update information. If a material error affects an accepted order, we will contact the customer and provide an appropriate lawful resolution.

We do not guarantee that the website will always be uninterrupted, secure or error-free.

SECTION 17 — DISCLAIMERS AND LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, EverWonder Post is not responsible for indirect, incidental, special or consequential losses arising from use of the website or products where such losses were not reasonably foreseeable.

We are not responsible for delays or failures resulting from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence, personal injury where applicable, or mandatory consumer rights.

Any limitation in these Terms applies only to the extent permitted under the law applicable to the customer.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to compensate EverWonder Post for reasonable losses or claims resulting directly from your unlawful use of the website, infringement of another person’s rights or material breach of these Terms.

This provision does not apply to ordinary consumer use or restrict any mandatory consumer protection.

SECTION 19 — TERMINATION

You may stop using the website at any time.

We may suspend or terminate access to the website or a customer account where reasonably necessary because of fraud, unlawful activity, security concerns or a material breach of these Terms.

Termination of website access does not automatically cancel a Monthly Membership. Membership cancellation must be completed according to our Purchase Options Cancellation Policy.

Terms which by their nature should continue after termination, including intellectual property, payment obligations and limitations of liability, will remain effective.

SECTION 20 — GOVERNING LAW AND CONSUMER RIGHTS

These Terms and purchases from EverWonder Post are governed by the laws of Switzerland, without excluding any mandatory consumer protection that applies in the customer’s country of residence.

Any dispute will be submitted to the competent courts in Switzerland unless mandatory law gives the customer the right to bring proceedings in another jurisdiction.

Nothing in these Terms deprives a consumer of rights that cannot lawfully be waived or limited.

SECTION 21 — SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will remain effective.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

SECTION 22 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our products, services, technology, business practices or legal obligations.

The current version will be published on this page with its revision date.

Material changes affecting an active subscription will be communicated where required by applicable law. Changes will not retroactively remove rights already acquired under an accepted order.
